Los Angeles is legalizing illegal residential units, just not your illegally converted garage…. yet.

To ease the current housing shortage in the city, the Los Angeles City Council unanimously voted Wednesday, June 24 to make it easier for unapproved housing units to become legal.

The law will make it easier to legalize dwellings found in multi-unit complexes that are not suppose to be there, like converted recreation rooms or a unit made into two. More than 1,700 of these illegal units were removed since 2010, and the city knows about an addition 600 that remain out of compliance that can benefit from the new ordinance.

The ordinance, proposed by Councilmember Felipe Fuentes (who represents Pacoima), however, only applies to illegal units in multi-unit complexes, not converted garages, which can be found on almost every block in Pacoima.

The Los Angeles Department of Building and Safety said it is difficult to know how many illegally converted garages there are in Pacoima or Los Angeles because homes are not routinely inspected, unlike apartment complexes which are inspected every four years, but Pacoima Beautiful estimates that nearly 20 percent of people in Pacoima rent a room or live in a converted garage.  

Fuentes’ office said he is hoping to work on this issue next, but first it is necessary to analyze the impact variances in this new ordinance will have. For example, currently zoning law requires a parking to be available per unit. Fuentes’ approved proposal will overlook such variances as long as “it meets certain fire, life safety, and habitability requirements.”

“Right now the issue is those residential apartments, and then we’ll see how this works out in the city, and then learn from this ordinance.  Learn best practices, then move to garages,”said a representative from Fuentes’ office. “We have to see best practices, see what works, what doesn’t work.”

  1. Legalizing apartment recreation rooms or creating a single rental unit out of a 3 bedroom apartment should be allowed. Because, if a developer can build a new large apartment building and use Senate Bill 1818, which allows the developer to provide less parking than is normally required by zoning laws, then they should not discriminate against existing apartment buildings who want to convert their recreation room to an apartment unit.

    City council doesn’t have to see how legalizing illegal units in apartments works out. No one will ever notice the change.
    I don’t trust city council or our state legislators to watch out for the best interest of LA residents.
    Now, the following is very important;
    The mystery question is, why would LA councilman Felipe Fuentes ever decide to set a precedent by attempting to change the character (zoning) of single family home neighborhoods by legalizing garage conversion’s to rental units? Unless he plans to declare them commercial properties, to set them up to lose their Proposition 13 protection if legislators are successful in taking away proposition 13 protection on all commercial property.
    It these garage conversions are legalized then Fuentes, “The Worst Legislator In California” should and shall include language that these properties nor the the rest of the single family home neighborhood can never loose their iProposition 13 protection.
